Terms and Conditions

These Terms and Conditions ("Terms") apply to everyone who uses jenniferwakefieldphotography.com (the "Site"). The Site is owned by Crystal Coast Dog, LLC, doing business as Jennifer Wakefield Canine and Equine Photography ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

Privacy

By agreeing to these Terms, you also agree to our Privacy Policy, which is part of these Terms. If the two ever conflict, these Terms control.

What we do

We create fine art portraits of dogs and horses, including studio and on-location sessions, Legacy sessions, and hunting adventures, and we offer artwork such as albums and wall art. The Site shares information about that work and lets you contact us and book.

Ownership of the Site and its content

Everything on the Site belongs to us or is used with permission of the owner, and is protected by copyright, trademark, and other laws. That includes the photographs, text, graphics, logos, video, and the code that runs the Site.

All photographs on the Site are our copyrighted work. You may not copy, download, screenshot for reuse, edit, print, post, or distribute any of it without our written permission. You may share a link to the Site or a page on it.

Your obligations

If you give us personal information through the Site, you agree it will be true, accurate, current, and complete, and that you will update it when it changes.

Sessions and artwork

Session fees, artwork orders, cancellations, and image licensing are covered by your client agreement with us, not by these Terms.

Referral links

Some links on the Site, such as links in Field Notes blog posts, may be referral or affiliate links. If you buy through one, we may earn a commission at no extra cost to you. We do not control those third-party sites and are not responsible for their content, products, or services. You use them at your own risk.

Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT THE LAW ALLOWS. WE DO NOT WARRANT THAT THE SITE WILL BE ACCURATE, COMPLETE, CURRENT, SECURE, OR AVAILABLE WITHOUT INTERRUPTION OR ERROR, OR THAT IT WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME LAWS DO NOT ALLOW CERTAIN WARRANTIES TO BE EXCLUDED, SO PART OF THIS SECTION MAY NOT APPLY TO YOU.

Limitation of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, USE, INCOME, OR PROFIT, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF WE WERE ADVISED OF THE POSSIBILITY. THIS APPLIES WHETHER THE CLAIM IS BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER THEORY. YOU ARE RESPONSIBLE FOR BACKING UP YOUR OWN DATA.

Indemnity

You agree to defend and hold us harmless from any third-party claim, loss, or demand, including reasonable attorneys' fees, arising from your use of the Site in violation of these Terms or from content you submit that causes us to be liable to someone else.

Governing law and venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any action arising from these Terms must be brought in the state or federal courts in Carteret County, North Carolina, and you consent to those courts' jurisdiction. We may still bring a claim in any location where we believe these Terms are being violated.

Waiver and severability

If we do not enforce a provision of these Terms, that is not a waiver of it. Any waiver must be in writing. If a court finds any provision unenforceable, it will be applied as closely as the law allows, and the rest of the Terms stay in effect.

Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on the Site, and your continued use of the Site means you accept them.

Entire agreement

These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Site and replace any earlier agreements about it. They do not replace any separate client agreement or order terms.
